Andrew Balbus was selected by Aspatore Books as one of the leading minds in this area of the law and was asked to contribute to the 2013 edition of Inside the Minds: Chapter 7 Consumer Bankruptcy Strategies. He also authors articles on Chapter 11 practice for the Norton Journal of Bankruptcy Law and Practice. He is the only graduate of Harvard Law School to have earned a Master of Law (LL.M.) degree in bankruptcy law. In addition to his legal education, he has a Master of Business Administration (MBA) degree in finance from the Columbia University School of Business and a bachelor’s degree magna cum laude in accounting/management science from Duke University. In 2016, Andrew was elected President of the Greater Danbury Bar Association for the 2016 – 2017 term.  In 2017, he became an Adjunct Professor at St John’s University School of Law.  During the spring semester 2017, Andrew co-taught “Domestic Relations in Bankruptcy” with Hon. Alan S. Trust, Bankruptcy Court Judge, Eastern District of New York.

In a typical individual case, we meet with you to learn about your financial situation. Most people want to pay their debts. A job loss, divorce, medical problem or a decline in the economy may make those debts, that were once manageable, unmanageable now. You may be facing foreclosure and want to save your house. Or, your house may be so far underwater that you would prefer to surrender the house to the bank and be relieved of any liability for the mortgage deficiency. Car loans pose similar issues. Almost everyone has significant credit card debt that has to be carefully reviewed to make sure it is dischargeable in bankruptcy. You will want to know if you can keep your house, cars and other assets. Houses and cars usually can be kept. Keeping other assets may require special planning in advance of bankruptcy. We educate clients about the entire bankruptcy process and what to expect to happen to their credit scores following bankruptcy.

Business cases differ significantly depending upon the nature of the business, whether the business can be reorganized, whether the business has to be liquidated, whether assets can be sold to pay creditors, whether contracts and leases can be restructured to save the business money and other issues. We work closely with the management to understand the business’s financial situation and to develop a strategy to take the business through bankruptcy and, wherever possible, to emerge as a healthy, reorganized business.
